What applies to the Peekami app and to buying Peekami Plus.

1.1 The provider of the "Peekami" app and the associated relay service is:

(hereinafter "we" or "Peekami").
1.2 These terms govern the use of the Peekami app on iOS, iPadOS, Android, macOS and Windows and the purchase of the paid tier "Peekami Plus". They apply to consumers within the meaning of section 13 of the German Civil Code (BGB).
1.3 The terms of the app store through which the app is obtained and a purchase is processed (Apple App Store, Google Play) apply in addition. Where these terms conflict with mandatory requirements of the store operator, the store operator's requirements prevail as far as the relationship between you and the store operator is concerned.
1.4 The usage notes on our website and the app's privacy notice explain the intended use and the data processing. They are part of the information we make available to you before a purchase.
2. What Peekami is
2.1 Peekami turns an existing smartphone, tablet or computer into a camera (the "camera device") that you can access from a second device (the "viewer device"): with live video, audio, two-way talk and alerts for noise or loss of connection. The devices are linked through a one-time pairing code or QR code (a "pairing"). One pairing corresponds to one household.
2.2 No user account. No account with a name, e-mail address or password is required. Devices identify themselves to our relay service using a random device identifier and a secret stored on the device. Anyone with access to your devices' pairing can access the camera. Keep pairing codes safe and remove pairings you no longer need.
2.3 No video archive. Video and audio are transmitted encrypted between your devices, either directly or through a relay server (TURN) operated by us. We do not store video or audio recordings and offer no archive, recording or playback of past footage. The event history contains only event type, time and observed duration.
2.4 Requirements. You need two compatible devices with a working camera and microphone, an internet connection on both devices and permission for camera, microphone and, where applicable, notification access. The camera app must remain open and the camera device awake; locking, switching apps, power-saving features, phone calls or a network change can interrupt the transmission. Supported devices and operating system versions are listed in the respective store listing.
3. Scope of service: Peekami (free) and Peekami Plus
3.1 Peekami (free) includes:
- live video, audio and two-way talk,
- noise and offline alerts,
- pairing without an account via code or QR code,
- one camera and one viewer per pairing,
- live sessions of up to ten minutes at a time, restartable as often as you like; the end is announced one minute in advance and is postponed while two-way talk is active (by at most 60 seconds),
- an event history of the last 24 hours,
- use on all supported platforms.
3.2 Peekami Plus additionally includes:
- live sessions without the ten-minute limit,
- up to two viewers per camera,
- an event history of 30 days, at most 1,000 entries per pairing,
- a second camera per pairing as soon as that feature is available, at no extra charge.
3.3 Peekami Plus comes in two forms:
- Plus · Household: a one-time purchase. The unlock applies to the pairing in which the purchase was made and therefore to all devices in that pairing, regardless of the platform of the purchasing device.
- Plus · Monthly Pass: a one-time purchase with a term of 30 days from activation. The Monthly Pass does not renew automatically and is not a subscription. If another pass is bought, the term is extended by a further 30 days. After expiry, the free scope applies again; existing pairings remain, and a second viewer is shown the Plus requirement at the next session start.
3.4 Fair-use limit. Peekami Plus is subject to a limit of 100 GB of relayed traffic (TURN) per pairing and calendar month. If it is exceeded, the quality of relayed transmission may be reduced for the rest of the month; access is never blocked. Direct connections between your devices are not affected.
3.5 Beta households. Pairings that took part in the closed test phase may be unlocked by us without a purchase. This unlock is a voluntary benefit and creates no entitlement beyond section 5.
3.6 We may change the values of the free tier (such as the session length) where this is necessary for operation and the free tier remains usable for a quick look home. Changes to paid features are governed by section 7.
4. Purchase, prices, payment
4.1 Peekami Plus is purchased exclusively as an in-app purchase through the App Store (Apple) or Google Play (Google). Payment processing, invoicing and, where applicable, refunds are handled by the respective store operator under its terms. We receive no payment data.
4.2 The price shown in the store at the time of purchase, including VAT, applies. A time-limited launch price is reflected solely through the store price; the end of a launch price is not a price increase within the meaning of section 7.
4.3 The unlock takes effect after our service has verified the store's purchase confirmation. Until then, the app shows the purchase as pending. If our service is temporarily unreachable, verification is repeated the next time the app starts; a paid purchase is not lost.
4.4 A household purchase can be assigned to only one pairing at a time. If it is assigned to a new pairing via "Restore purchases", the previous pairing loses its Plus unlock.
4.5 Windows. Purchases are currently not possible in the Windows app. A household purchase made on iOS, macOS or Android also applies to Windows devices in the same pairing.
4.6 Restore and device change. Within an existing pairing, the unlock is retained when a device is replaced. After a reinstall or a complete re-pairing, you can reassign the household purchase via "Restore purchases" using the store account that made the purchase. Monthly passes are only restored while their term has not yet expired.
5. Operation, availability, discontinuation
5.1 Peekami requires a relay service operated by us for pairing, connection setup, alerts and the Plus unlock. We operate this service on a best-effort basis. We cannot guarantee a particular availability, transmission quality or reachability from particular networks (such as restricted corporate, hotel or mobile networks). Maintenance, outages at network, hosting or push providers and changes to operating systems may temporarily impair the service.
5.2 We may apply capacity and abuse limits (such as the number of simultaneous connections per network address, message rates, registration limits) as long as they do not unreasonably restrict contractual use.
5.3 Discontinuation. Should we discontinue the relay service, we will announce this at least twelve months in advance in the app and on our website. Until the announced date, Peekami Plus remains usable for unlocked pairings. Statutory claims arising from a discontinuation remain unaffected. Peekami Plus is an unlock for the period the service is operated; it is not a promise without time limit.
5.4 Updates. We provide the updates necessary to keep the app in conformity with the contract for the period you can reasonably expect given the nature and purpose of the app (section 327f BGB). Whether and how long older operating system versions are supported is stated in the store listing and in the app. If you do not install updates we provide, we are not liable for defects resulting solely from that, provided we have informed you of the consequences.
6. Your obligations
6.1 Point the camera only at areas you are lawfully allowed to observe and inform people present about the transmission. You are responsible for complying with data protection and personality rights when using the camera.
6.2 Share pairing codes only with people who may see and hear the camera area. Remove pairings you no longer need.
6.3 You must not misuse the service, in particular not attempt to circumvent protective mechanisms, overload the service or forge purchase confirmations. In case of serious misuse we may block individual devices or pairings; a paid entitlement is then retained only to the extent required by law.
7. Changes to these terms and to the scope of service
7.1 We may change these terms and the scope of service where there is a valid reason, such as changes in the law, store requirements, technical platforms or security requirements, and the change is reasonable for you. For paid features, the core functions described in section 3.2 are retained or replaced by equivalent ones. We announce material changes at least six weeks in advance in the app and on the website. Section 327r BGB remains unaffected.
7.2 Price increases apply only to future purchases. Household unlocks already bought and running monthly passes are not affected.
8. Right of withdrawal for consumers
Consumers have the following right of withdrawal for contracts on digital content.
Withdrawal instruction
Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the day the contract is concluded. To exercise your right of withdrawal, you must inform us (Anton Metzler, Vinzentiusstr. 37, 83395 Freilassing, Germany, metzler_anton@icloud.com, +49 176 80698384) by an unequivocal statement (e.g. an e-mail) of your decision to withdraw from this contract. You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal. If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and at the latest within fourteen days from the day on which we receive notice of your withdrawal. Because payment was made through the App Store or Google Play, the reimbursement is processed through the payment method used there; you will not incur any fees as a result of the reimbursement.
Expiry of the right of withdrawal. For a contract on the supply of digital content not supplied on a tangible medium, the right of withdrawal expires if we have begun performance after you have expressly consented to performance beginning before the end of the withdrawal period and you have acknowledged that you thereby lose your right of withdrawal (section 356 (5) BGB). This consent is requested in the store's purchase flow.
Practical note. Refunds are executed by the store operator. The easiest way to request a refund is directly there: for Apple via reportaproblem.apple.com, for Google via the order history in Google Play. We support refunds by revoking an unlock server-side or granting one as a goodwill gesture; we do not make payments ourselves.

9. Warranty
The statutory provisions on consumer contracts for digital products (sections 327 et seq. BGB) apply to defects in the app and in Peekami Plus. Please report defects to metzler_anton@icloud.com with app version, platform and a short description; do not send camera footage, pairing codes or device keys.
10. Liability
10.1 We are liable without limitation for damage resulting from injury to life, body or health, for intent and gross negligence, under the German Product Liability Act and to the extent of a guarantee we have given.
10.2 In case of slightly negligent breach of a material contractual obligation (an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
10.3 Peekami is an additional way to check in, not a surveillance, alarm, emergency-call or security system and not a medical device. Video, audio and alerts can be delayed or fail. Peekami is not intended to monitor babies, children, people in need of care or animals without personal supervision and does not replace required care. We give no assurance that particular events will be detected or reported. Liability under section 10.1 remains unaffected.
11. Term and termination
11.1 You can end free use at any time by removing the pairing, deleting the device access in the settings and uninstalling the app.
11.2 Peekami Plus · Household is a purchase without a term and does not end by termination; it ends with the discontinuation of the service under section 5.3. Peekami Plus · Monthly Pass ends automatically when the 30 days expire.
11.3 If you delete the device access of all devices in a pairing, a paid household purchase remains available for later restoration via the store account (section 4.6).
12. Governing law, consumer dispute resolution
12.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another state, the mandatory consumer protection provisions of that state continue to apply.
12.2 Jurisdiction is determined by statute.
12.3 Dispute resolution. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (VSBG).
12.4 The contract language is German. These terms are kept available in the app and on the website; we do not separately store the contract text for you after conclusion. Please keep the store's purchase confirmation.
13. Final provisions
Should individual provisions be invalid, the remainder of the contract remains valid. The statutory provisions apply in place of the invalid provision.
